Electronic exemption procedure from January 2023

Simple and fast: Applications for exemption from the statutory pension insurance obligation must be submitted electronically from 1 January 2023.

The electronic application form is provided by the "Datenservice für berufsständische Versorgungseinrichtungen GmbH" (DASBV). For the application, information on the employment relationship as well as on the membership in the pension scheme and in the chamber is required.

The fully completed application for exemption is received by the SÄV with legal effect after it has been sent. As soon as the SÄV has confirmed membership in the pension fund and Saxony Chamber of Physicians (Landesärztekammer), the application is forwarded to the Deutsche Rentenversicherung Bund (DRV) for examination. The applicants receive the decision on their exemption from the DRV in writing by post. The SÄV, for its part, is informed electronically.

The e-exemption is obligatory according to § 6 para. 2 SGB VI n. F., in order to accelerate and simplify application and processing. This is because it is still the case that every time there is a change of employment, the exemption from the statutory pension insurance obligation must be applied for again.

Frequently Asked Questions about the E-Exemption

Yes, as of 01.01.2023, the application for exemption from compulsory insurance in the statutory pension insurance can only be submitted electronically. This also applies if the application is made for an employment that was taken up before 01.01.2023. Paper applications submitted after 01.01.2023 do not comply with the electronic form and are therefore invalid.

For members of the Saxony Medical Pension Fund, it has already been possible to submit the application for exemption online since 02.12.2022.

The legal basis for the obligation to submit the application electronically is § 6 paragraph 1 sentence 1 no. 1 SGB VI in conjunction with § 6 paragraph 2 sentences 2 to 7 SGB VI. This regulation has been introduced by the Seventh Act Amending the Fourth Book of the Social Code and other laws and will enter into force on 01.01.2023.

The application requires information on the employment relationship and membership in the pension fund and the chamber. You will be guided through the form with the help of descriptive fields and predefined selection options. There are also "mandatory fields"; the form cannot be sent without these being filled in. However, we strongly recommend that you also fill in all other fields in order to avoid queries from the statutory pension insurance or the Sächsische Ärzteversorgung, as this can sometimes lead to considerable delays in processing the application. Please fill out the online form as completely and accurately as possible, especially with regard to the information on the employment relationship and the employer. The more complete the information, the faster the application can be processed. Once everything has been filled in, please click on "Submit". As soon as the application for exemption has been received electronically by the Sächsische Ärzteversorgung, the application is considered to have been submitted with legal effect.

No, it is generally sufficient to complete the application form in full. If you appoint an authorised representative to submit the application on your behalf, the corresponding power of attorney must be attached to the application. An upload area has been set up in the electronic application form for this purpose.

As with the application procedure in paper form, the application for exemption is deemed to have been submitted with legal effect when it is received by the pension fund; from 01.01.2023 exclusively by electronic means. For security reasons, we recommend that you save the confirmation of the application with the e-exemption ID and the date of creation. You will not receive a confirmation of your application by e-mail.

As before, the decision on exemption from compulsory insurance in the statutory pension insurance scheme is made by the statutory pension insurance. The Sächsische Ärzteversorgung only confirms membership of the Saxony Chamber of Physicians (Landesärztekammer) and the pension fund. You will receive the decision by post. Notification of the decision by electronic means will only be made if you have provided a valid De-Mail address in the application form.

At present, there is no automatic notification to the employer. You will receive a copy of the exemption notice by post from the statutory pension insurance. Please send this to your employer. An automatic notification to the employer is only planned from 01.01.2025. 

The Sächsische Ärzteversorgung receives an electronic copy of the exemption notice from the statutory pension insurance.

Frequently Asked Questions about the Exemption-Process

Members of the Sächsische Ärzteversorgung who work in a dependent employment relationship are subject to compulsory insurance in the statutory pension insurance. In order to avoid paying double contributions to the statutory pension insurance and to the Sächsische Ärzteversorgung, exemption from compulsory insurance in the statutory pension insurance can be applied for.

If you do not exempt yourself, there is compulsory membership of both the statutory pension insurance and the Saxony Medical Pension Scheme. For you, this also means a double obligation to pay contributions. Your employer pays the pension insurance contribution to the statutory pension insurance and you yourself have to pay the minimum contribution to the Sächsische Ärzteversorgung in accordance with the statutes.

The application for exemption from compulsory insurance in the statutory pension insurance must be submitted within three months of the start of employment so that the exemption can be pronounced from the start of employment. If the application is submitted later, the exemption only takes effect from the date of receipt of the application by the pension fund. It is advisable to apply as early as possible, even before the start of your employment.

Since the exemption can only take effect from the date of receipt of the application by the pension fund, an application should be submitted as soon as possible after the deadline has expired. For the time until the application is received, there is a double obligation to pay contributions to the statutory pension insurance and to the Saxon Medical Pension Scheme (see: "What happens if I do not have myself exempted (in time)?").

For each new or additional employment relationship, a new application for exemption from compulsory insurance in the statutory pension insurance must be submitted for the respective employer. If there is a "significant change" in your area of responsibility, a new application for exemption must also be submitted. There are currently no clear criteria for defining a "significant change". However, a change of station or career level does not count as such and does not entail a new application.

In case of doubt, an application for exemption should be submitted as a precaution.

Yes, a new application for exemption must be submitted for each individual assignment concluded through a separate employee leasing contract, even if the assignment only covers a few days.

An exemption can be granted if medical or veterinary knowledge is applied in the employment. This is often not limited to classical curative activities. The competent chamber is responsible for deciding whether the activity is medical or veterinary.

If you are uncertain whether you are self-employed or employed under social insurance law, you can initiate a status determination procedure according to § 7 a para. 1 sentence 1 SGB IV. The procedure is carried out by the Clearing House of the German Pension Insurance Association.
